Jorge Luis Peinado-Leon appeals his conviction for possession with intent to distribute approximately 120 kilos of marijuana in violation of 21 U.S.C. § 841(a)(1) and (b)(1)(B)(vii). Peinado-Leon alleges on appeal, as he did below, that the automobile search conducted by border patrol agents was unlawful and consequently the marijuana found pursuant to that search was inadmissible at trial. Additionally he argues that during trial the prosecutor violated Rule 16(a)(1) of the Federal Rules of Criminal Procedure by failing to disclose information from a prior arrest and subsequently using that information to impeach him on cross-examination.
